READ BEFORE CONFIRMING AND AGREEING
WAIVER OF LIABILITY, INDEMNIFICATION, AND MEDICAL RELEASE for event participation and visits to Chaos Fab Shop, Chaos Off Road Park, Wheelerman, Chaos Off Road, and any other activities of the Chaos Companies.
To be acknowledged and agreed to by adults on their own behalf as well as on behalf of any and all minors (persons under the age 18) that accompany them and participate in the visits, trail rides, activities and events organized by Chaos Fab Shop LLC, Chaos Off Road LLC or the Chaos Hero Project Non-Profit Organization, including (hereinafter "Chaos"). The participant hereby agrees to release and hold harmless any owners, sponsors, trail guides,
workers, and owners of both public and private land where a Chaos event is held. This shall also include officers, directors, agents, promoters, representatives
and employees of Chaos.
Acknowledgment and Assumption of Risk
I am aware of the dangers and the risks to my person, property, and persons under 18 that are accompanying me and are participating in Chaos, visits, activities and events.
I understand that participation involves certain risks for physical injury. I also understand that there are potential risks of which I may not presently be aware. Because of the dangers of participating in this activity, I recognize the importance and agree to fully comply with the applicable laws, policies, rules and
regulations, and any staff instructions regarding participation in this activity.
I understand that Chaos does not insure participants in their visits, activities, or events that any coverage would be through personal insurance, and Chaos has no responsibility or liability for injury resulting from this activity.
I voluntarily elect to participate in this activity with knowledge of the danger involved, and I hereby agree to accept and assume any and all risks of property damage, personal injury, or death of myself or any minors that may be accompanying me.
Photo, Video, Media release: I understand that all publications, digital image and/or video files taken of me or by me during this or any other Chaos event are wholly owned by Chaos, who reserves the right to use these images and/or video for publication as they see fit, for any purpose, without compensation to me. I may not at any time use images, interviews and videos of Chaos properties and/or during Chaos events for commercial purposes without a written licensing
contract.
Completing a registration secures your request to participate, Chaos reserves the right to refuse your participation.
There will be absolutely no refunds of any money paid for or toward any events, for any reason. If you can not participate in an event, you may find someone to take your place, in most cases we will allow a transfer of your ticket to another qualified and approved individual.
Waiver of Liability and Indemnification: In consideration for being allowed to voluntarily participate in the Chaos visit, activity or event, on behalf of myself, my personal representatives, heirs, next of kin, successors and assigns, I forever: waive, release, and discharge Chaos and its agencies, officers, and employees from any and all negligence and liability for my death, disability, personal injury, property damages, property theft or claims of any nature which may hereafter accrue to me, and my estate as a direct or indirect result of my participation in the above referenced activity or event; and defend, indemnify, and hold harmless Chaos, its agencies, officers and employees, from and against any and all claims of any nature including all costs, expenses and attorneys' fees, which in any manner result from participant's actions during this activity or event. I hereby consent to receive medical treatment which may be deemed advisable in the event of injury, accident or illness during this activity or event. This release, indemnification, and waiver shall be construed broadly to provide a release, indemnification, and waiver to the maximum extent permissible under applicable law.
I, the participant, affirm that I am at least 18 years of age and am freely agreeing this form. I have read this form and fully understand that by agreeing this form I am giving up legal rights and/or remedies which may otherwise be available to me regarding any losses I and minors that accompany me may sustain as a result of my participation. I agree that if any portion of this waiver is held invalid by the court, the remainder will continue in full legal force and effect.
